A previous employer claims I made income w/them in a yr I did not work; What type of legal actions can I take?

I was sent a "W-2" Form for wages I did not make in 2007. My employment with the company was terminated in 2006. The income they claim I made, I did not receive. Is there such an attorney as a Employment Law Attorney?

This could be a simple misunderstanding. They may have generated checks for accumulated vacation pay or something that went into the next year and simply put it in your file or a drawer in the accounting office. I would contact them and ask them to mail you your checks or go pick them up. This could also be some sinister deal. Maybe they kept you on the payroll but gave the wages to a relative of the boss or an accounting person. I don't know how this effects your taxes but it probably wont be worth hiring and paying for an attorney to fix an error that occurred a year ago.

Answering your questions in reverse order. Yes, there are employment law attorneys. Most of us are members of the National Employment Law Attorneys bar assoc. www.nela.org. You should look for an attorney in your area. This problem needs to resolved right away or you will have IRS problems. In case there is a "simple" error, you may want to contact the former employer and tell them that they sent you the wrong W-2 and what are they doing to correct the error. You also may want to find your check stubs or any indication of your pay.

did you work at the end of the year - w-2 income is based on the date of payday - maybe your last check was dated in early Jan 2007 - then you have to claim those wages in 2007 - check your paystubs - which you are supposed to keep for such purposes or call them and ask to see a payroll report showing the paydates
